BEEPBEEP.PH PARTS MARKET
1.2 beepbeep.ph Parts Market is an online platform for selecting and purchasing different car parts and accessories (“Purchasing”) along with the installation of the purchased car parts and accessories through the Platform (“Purchase Installation”) as well. Both Purchasing and Installation will be coined as the “Services” of the Platform. For Purchasing, transactions will be between the Buyer (the “Buyer”) and our partner parts and accessories shop vendors (the “Seller”). Purchase Installation transactions, on the other hand, will be between the Buyer and our accredited parts and accessories seller-installer and/or installer only (the “Installer”).
1.4 Without limiting any other remedies, beepbeep.ph may limit, suspend, terminate, modify, or delete accounts or access to the platform or portions thereof if you are or if beepbeep.ph suspects that you are, failing to comply with any of these terms of service or any actual or suspected illegal or improper use of the service, with or without notice to you. You can lose your user name and persona in the platform as a result of account termination, as well as any benefits. Privileges associated with your use of the platform and beepbeep.ph is under no obligation to compensate you for any such losses or results.
1.5 Without limiting our other remedies, we may limit, suspend or terminate the user account or portions thereof, prohibit access to the platform and their content, services, and tools, delay or remove content, and take technical and legal steps to prevent users from accessing the platform if we believe that they are creating risk or possible legal liabilities, infringing the intellectual property rights of third parties, or acting inconsistently with the letter or spirit of our terms or policies. Additionally, we may, in appropriate circumstances and at our sole discretion, suspend or terminate the account of users who may be repeat infringers of third party intellectual property rights.
1.6 beepbeep.ph reserves the right to terminate any account that has been inactive for 180 days.
1.7 beepbeep.ph reserves the right to stop offering and/or supporting the platform or a particular service or part of it at any time, at which point your account to use the platform or a part thereof will be automatically terminated. In such an event, beepbeep.ph shall not be required to provide refunds, benefits, or other compensation to users in connection with such discontinued service.
1.8 Termination of your Account can include disabling your access to the Service or any part thereof including any content you submitted or others submitted.
1.9 You may terminate your Account at any time and for any reason.
2. USAGE AND PRIVACY
2.1 Access to and use of password protected and/or secure areas of the Platform and/or use of its Service is restricted to Buyers with accounts only. You may not obtain or attempt to obtain unauthorized access to such accounts on this Platform and/or its Services, or to any other protected information through any means. The user shall be responsible for taking all the necessary protection to keep their passwords safe and any unauthorized access to the user account shall not make the Platform in any way liable for any damages of any form due to the user negligence to keep their account safe.
2.3 The actual contract for sale is directly between Buyer and Seller and/or Installer and the Platform accepts no obligations in connection with any such contract. Parties to such transactions will be entirely responsible for the sales contract between them, the listing of goods, warranty of purchase and the like. The Platform is not involved in the transaction between Buyers. The Platform will filter all incoming products that will be posted for sale and the Platform reserves the right to remove any Content or information posted by the Buyer or Seller that goes against our website policies and values. The Platform does not guarantee that Users will actually complete a transaction. The buyer, seller, and Installer are each responsible in conducting the due diligence of ensuring the legitimacy, reliability, and genuineness of each of their transactions.
3. PURCHASE AGREEMENT
3.1.1 Through the beepbeep.ph Parts Market, we provide an electronic web-based platform for the purchase and/or installation of car parts and services. The Platform reserves the right to limit certain features and functions to the Buyers. The Platform does not represent the Buyer or Partners in specific transactions whether or not such transactions are made on or via the Platform. The Platform does not control and is not liable to or responsible for the quality, safety, lawfulness or availability of the products or services offered or the ability of the Partners to complete a sale or the ability of Buyers to complete a purchase.
3.1.2 Each Buyer accessing or using the Platform and its services shall fully assume the risks of conducting any purchase and transactions including, but not limited to, misrepresentation of products and services, unsatisfactory quality, failure to meet specifications, defective products, delay or default in delivery or payment, cost miscalculations, breach of warranty, breach of contract, errors in Installation of products, and transportation accidents (“Risks”). Each Buyer agrees that the Platform shall not be liable or responsible for any damages, liabilities, costs, harms, inconveniences, business disruptions or expenditures of any kind that may arise a result of or in connection with any Risks.
3.1.3 Maintenance of the Platform will be executed from time to time. Even though we would want to avoid disruption at most, there is no assurance that the Platform will always be without disruptions. Therefore, we provide the Website on an “as is” and “as available” basis.
3.1.4 There will be no guarantee that the Platform and any other websites the Platform is linked to or from, is free from viruses and/or malicious or damaging computer programs or scripts. The responsibility of ensuring that appropriate security software is installed falls on the hands of the Buyer and not the Platform.
3.1.5 The Platform will only address order related concerns and will not entertain concerns once order/installation is fulfillment.
3.2 Warranty and Liability
3.2.1 The following parts and accessories (the “Products”) displayed on the Platform are provided without any guarantees, conditions or warranties as to its accuracy or suitability for Purpose.
220.127.116.11 The Platform excludes its responsibility on all agreements, warranties, and other terms that might be made between the Buyer and the Seller and/or the Installer unless implied by the Platform (promos, sales, and discounts).
18.104.22.168 The Platform excludes its liability for any direct, indirect consequential loss or damage incurred by any Buyer, Seller, and/or Installer in connection with our Platform or in connection with the use, incapacity for performance, or the results of the use of any websites linked to the Platform and any materials posted on it, including any liability for loss of income and/or revenue, loss of business, loss of profits, loss of anticipated savings, loss of data, and any other loss or damage of any kind, whether caused by irresponsibility, negligence, or infringement of contract/s.
3.2.2 The Platform is neither liable nor responsible for any failure to perform responsibilities under the terms and conditions caused by external parties.
3.2.3 Warranty policies are determined by the Partner and the Platform is not liable for any Warranties.
3.3 Returns & Exchange
3.3.1 All products that are sold on the Platform are sourced from our partner Sellers and Installers (the “Partners”) and thus buyers should take into consideration the logistics process including the costs of products. This idea is likewise applicable to the returned products that are to be shipped back to our Partners.
3.3.2 The returns and exchange policy will depend on the Partner and not the Platform.
3.3.4 The Platform is not liable nor responsible for any failure to perform responsibilities under the terms and conditions caused by external parties since the Platform is only an aggregator of the products to the Buyers.
3.3.5 All necessary costs will depend on the Partner’s returns & exchange policy.
3.4.1 The refund policy will depend on the Partner and not the Platform.
3.4.2 The Platform is not liable nor responsible for any failure to perform responsibilities under the terms and conditions caused by external parties since the Platform is only an aggregator of the products to the Buyers.
3.4.1 Refund amounts are payable for the following valid and verified condition
22.214.171.124 The Platform is to refund products that are damaged due to transit. The Partner will be the one to shoulder all necessary costs (product cost, shipping cost, and duty) as the Platform is not liable for the logistics of the said products.
126.96.36.199 The Platform is to refund (product cost, shipping cost, and duty) for products that are Malfunctioning, defective, or are dead on arrival.
188.8.131.52 For payments made via credit card, the refund will automatically be reversed and credited back into the credit card. This should reflect on the Buyer’s billing statement. Payments made via over-the-counter will be deposited in the customer’s preferred bank.
184.108.40.206 No refund is allowed once purchased product is already installed by our Installers and/or non-partners.
220.127.116.11 For payments made via Cash on Delivery or online transaction, send us an email at [email protected] with your bank details where we can deposit the refund.
4. DISPUTE RESOLUTION & LAW
4.1 If a dispute arises between you and beepbeep.ph, we strongly encourage you to first contact us directly to seek a resolution by going to our customer support at [email protected].
4.2 The terms of service shall be governed and construed in accordance with the laws of the Republic of the Philippines.
4.3 You agree that any and all actions arising out of the interpretation and enforcement of the terms and conditions of this AGREEMENT shall be brought exclusively to the proper courts of Quezon City, National Capital Region, Philippines
